client calls for a mold inspection, as the conversation goes on the client states that

she rents not owns the property
will not be informing the owner of a mold inspection
this house has more problems then mold
they want to get out of the lease
if there is mold they are leaving

I don't see why they would. You're not doing any invasive testing. You're note treating anything. All you're doing is walking around and writing up your opinion. While your client is renting the place she has the right to have people over. Unless there's something special in NH state law, I can't see a problem. I've seen other inspectors go in and inspect a place before a client moves into a rental for documentation to get their security deposit back later.
