Like everyone has said Dennis, you're doing an inspection for them. A non-invasive inspection. They can do what they want with the results. I'm sure it's just as Drew said, they need proof before approaching the landlord.

Include a clause for expert witness fees should you be required to give testimony, speak to attorneys, etc...

$150 - $200 p/hour with a 4 hour minimum is appropriate to start.  It also works as a deterent to keep you out of the legal issues...

Dennis - I was called by a tenant once because of a moisture issue in the front entry way.  There were problems with a parquet floor coming loose and warping.  The owner fixed the floor issue once but said that if it happened again it was because the tenant was leaving the door open during rain storms.  (We all do that...)  The tenant said it was another problem.

The tenant found my website through his search engine (thermal imaging) and called me to IR the problem.  The owner had replaced the front door just before this tenant had arrived, some three years ago.  The IR found that water was getting in under the front door assembly, which was improperly installed.  That is what was causing the moisture and the loosening parquet.  So the owner was at fault, not the tenant.

The tenant wanted the IR to get his security deposit (two months!) back.  My IR exam was far cheaper than that.  The owner was informed as to my findings and behold and lo, the tenant got his security deposit back. 

In your case, the mold could be caused by something the tenant is doing (bad shower curtain, splashing water from the laundry tub, who knows) or by something wrong with the plumbing.  Sounds like the tenant wants to be absolved of this when they leave the house.

Your concern is being drawn into a dispute circumstance.  All they have to do is look at your findings.  In my opinion, the mold test is not all you should do.  Mold is the symptom of a problem.  It's the problem that needs resolution.  That may or may not be the tenant's responsibility. 

Will is very experienced at dispute circumstances and I would listen to what he says!

Jay you are absolutely correct I Have done many mold inspections and have always found the root cause , , part of the cause is that this basement leaks as relayed by the tenant, but they had no interest in the cause,  just the existence  so they can get out of that lease .Anyway I passed on the inspection because It in my mind would have been incomplete, I also feel that the landlord should have a chance to re mediate, call me crazy but I 'm ok with the pass

Dennis,

I understand you want to be comfortable, but I don't follow what you're saying. I don't see anything that prevents the landlord from hiring their own inspector to refute the findings.
