Dennis, when you do a home inspection, are you concerned at all about the sellers rights to your findings? If your client wants to get out of the deal? Rights to the information is the lawyers job. I wouldn't hesitate at all to do that mold job.

no not at all, I Guess what I struggle with is this 1, the clients are aware they have mold because they have been cleaning it up, 2. they never notified their landlord about the mold problem so he does not even know about it, like they said they want out of lease, so this is different then a sale there are lease laws to deal with , , stuff like this I do not like, I lost a 15,000 sq ft mold inspection at a condo this year because the condo assoc rules stated that all must agree to work done on any common area

That's a valid concern. The flip side could be that the tenants might know their landlord, and they might need confirmation before they approach the LL . The Land Lord might really give them a hard time without proof.
