TOPIC: Have to give a deposition

Hi everyone
I did an inspection last month for a client who was getting divorced, and she needed a home inspection so she would know the condition of her house. I received a subpoena for deposition from her husbands lawyer. has anybody ever have to go through this?

Jeff - everything you have to say is in your report.  That is all you need be concerned with.  Anything as regards your short relationship with the soon-to-be ex-wife is something you will have very little care for.  It was brief, we didn't speak much except to discuss the report, she didn't mention the husband, it was a professional visit, etc.

I did that once, and was filmed, while conducting the inspection.  I was not deposed because everything I had to say was already there.  Also, there were four people present during the inspection so no one could say that I was colluding alone with the ex-wife.

I was by myself. I was just polite and chatted a little but it was basically about the issues as far as I could recall. I kept it professional. As far as i know they really just want to confirm everything on the report because the report is not a certified court doc. My lawyer will be there just in case

Your deposition is a court doc.  DO NOT vary even a word from what you say in the report.  Have the report in front of you.  Read it and confirm that what you wrote is what you saw and what you meant.
