will do i am just having the lawyer ther just for my peace of mind. I just do not like getting dragged in like this. i know they are going to try to ask if I colluded with the wife. I can barely remember any of the conversation that I had with her. that is why I have my lawyer there just in case they try something

Yes, I go through it once and a while. I am an expert witness for structural issues with my county superior court. It is quite easy, do not be guarded in your answers, be cooperative and don't be afraid to say I don't know if you truly do not know the answer to a question. Brush up on chronological order of a few things, such as your education, work experience,(HI or other). These questions may seem irrelevant, but attorneys ask odd questions depending on which way they are going. Don't try to out think the attorney, just answer as asked and you will do fine. Lastly, remember to SAY yes or no the court reporter cannot record your nodding or shaking your head.

In the future, if you know your report is being used for anything involving possible litigation, be sure and get an expert witness agreement signed prior to inspection.  This will allow you to charge the client for your time and in many cases will stop them from calling you to testify as they don't want the additional expense.  I'm currently charging $175.00 p/hour billed in quarter hour increments with a 4 hour minimum.

If you don't have this agreement, in California they'll pay you $38 for the entire day, (SUCKS!).

Jay is correct, don't vary from your report.  If you're not sure, refer to the report.  Your attorney will advise you to have (4) basic answers:

1.  No
2.  Yes
3.  I don't know
4.  I don't recall

Don't expand on any answers, that's were you start to get chatty and the attorney for the other side will hammer you...

I perform expert witness services about 5-6 times per year.  The depo is no big deal, just a waste of your time....

Will I have an expert testimony clause built right into my main agreement. No minimum charge, just logged hours plus travel.
