Hey Mike, the only one who can give you an answer on this with any authority is your attorney. I could tell you what I think based on what my interpretation of NJ law is. (notice my wording) I would not be representing you in court though.

My attorney is a close and trusted family friend, and he emails me NJ case law involving HI's a couple of times a month. It is unbelievable the number and types of cases that are brought against HI's either with or without merit. The creativity involved in these types of cases and the individual law in each state is the reason why only your attorney can answer this properly.
