Well..... Yeah, it is a defect.

IRC 2722.2 Hot Water. Fixture fittings and faucets that are supplied with both hot and cold water shall be installed and adjusted so that the left-hand side of the water temperature control represents the flow of hot water when facing the outlet.

Same requirements in the IPC (207.4)  and UPC (601.3) .  Hot on the left.

Big time defect and a safety issue if it is on the right.

Thanx guys...I have the Code Check and an IRC book...I guess I should read them more often! I've seen this on lots of homes, I usually comment on it but don't call it a defect. I figure it's safety related because of scalding.

Now I know I can check it as a defect and needing corrected.

Is there even a working overflow drain?  It looks like that hole is puttied or taped over from the back.
