Is there an easy way to find out if there is any litigation at the moment? Is there website or do I call the court house? Asking the seller or buyer would seem strange wouldn't it?

If it's currently being litigated you'd have a hard time getting info. The court clerks aren't going to look it up. Afterwords it becomes public info and you can look it up.

The way I look at it is I am there to inspect the property and do the best inspection job I can nothing else concerns me just the task at hand. I make sure I take plenty of photos of everything not just what will show up in the report and turn out the a good report. ;)

Ask your client.  It won't be a problem.  You'll want to know for several reasons, most important being, you may have to testify regarding your findings.  If you haven't established an hourly rate for litigation related activities they can subpoena you for a mere $37.50 per day....  Secondly you'll want to ask many questions and gather information regarding the litigation issues.  Have they concealled some of the areas of concern, etc..  When I do litigation work, I often bring in specialty sub contactors to cover all the bases, (Roofer, HVAC, Electrician), etc...
