#1On a outside slope that has concrete stairs going up it, all at grade level, is a handrail required? #2 If each tread is greater then 36", is it considered a landing or a tread.  If it is indeed a landing, can the height of the riser differ, or most they be the same as they are required in stair treads?

How many stairs are there? How tall is the riser on each stair?

Got any pictures? If I am picturing what you mean right, if there are 4 or more stairs it needs a handrail. I believe if they are 36" they are a landing and do not need a handrail. I would think the height could differ as long as it does not exceed the 8" height.

Further thought, if the stairs and handrail, or lack of handrail are outside the house, and not directly serving the house, does the code even apply. Example, hillside lot with a patio area at the top.

A home inspection is for Safety and Habitability.  Stairs without railnings are unsafe, report it.  The code is a guideline to help you define Safe and Habitable.  Remember that code is that absolute worst you can build a home and still pass.  It is not a goal to shoot for but rather a floor to build from.

Nicely put!  I run into  subs when I do QC inspections that are annoyed and brag how everything they do is done to code. Its like there saying "everything we do, we do the minimum."
