That's why the term "Failed During Inspection" is so great. If that ever happened that would be the term I would use, because you didn't do anything to cause the leak, it failed while you were testing the plumbing and checking the tub for leaks. Seller would have no case against you, they would have to prove you intentionally damaged it to make it leak.
